The agreement between Lulu’s Bus Stop Photos LLC and our clients for photo booth services.

Throughout this Agreement, “Provider” refers to Lulu’s Bus Stop Photos LLC (“we,” “us”), and “Client” refers to the individual or organization booking our services.

Scope of Services

The Provider agrees to provide photobooth services (the “Services”) for the Client’s event as described below:

  • Camera Setup
  • Touchscreen Interface
  • Customizable Branding
  • Lighting Equipment
  • Props and Accessories
  • On-Site Attendant
  • Backdrop

The final bill will be issued on the day of the event.

Miscellaneous Fees

The Client shall be responsible for any additional fees or expenses incurred beyond the scope of the original Services outlined in this Agreement. Parking must be provided within a reasonable distance from the photo booth set-up location. Travel within 25 miles from Northlake, TX will be free of charge. Any location beyond that will be charged at a rate of $.75 per mile each way, as well as any tolls incurred. Where such costs are incurred, they will be added to the final bill due on the day of the event.

Photo Booth Booking

The agreed date and Services will be locked in once the Agreement is signed and the non-refundable deposit of $100 is paid. Any remaining balance will be due 7 days before the date of the event.

Venue Access and Setup Requirements

The Client agrees to provide the Provider with access to the event venue at least 1 hour prior to the scheduled start time of the event. In the event that the Client fails to provide timely access to the venue, the Provider shall not be held responsible for any resulting limitations or compromises in the Services. The Client shall also provide an appropriate space for the setup of the photo booth. The recommended space requirement for the photo booth setup is 20 x 20. The Client shall ensure that sufficient power outlets (3-prong outlets, 10 amps, 110V) are available near the designated setup area. In the event that electrical power is unavailable, a $100 generator charge will be applied.

Breakdown Services

The Client also agrees to schedule a minimum of 1 hour for breakdown. Breakdown and haul-away services are provided as part of this Agreement.

Photo Booth Equipment

The Provider retains ownership of all photo booth equipment provided unless stated otherwise. The Client shall be responsible for any damages, losses, or theft of the equipment that occurs during the event. The Client shall reimburse the Provider for the full cost of repair or replacement of any damaged, lost, or stolen decor equipment. All rented decor must be returned to the Provider within 72 hours, or an additional fee will be charged.

Photo Booth Operations

The photo booth shall be operational for a minimum of 85% of the agreed rental duration. The photo booth may require short operational breaks for routine maintenance (adjusting lighting, adjusting the camera, etc.) during the event.

Model Release

The Client acknowledges and agrees that during the event, attendees and participants may have their photos and videos taken while using the photo booth. By using the photo booth, event attendees automatically grant the Provider the unrestricted right and permission to use their photos, images, and videos for promotional and marketing purposes related to the Provider’s services, without the need for further consent or compensation. The Provider will display a notice within the photo booth clearly stating that by using the photo booth, attendees consent to having their images captured and potentially used for promotional purposes.

Rescheduling and Cancellation

The Client may request to reschedule the event to a mutually agreed-upon date and time, subject to the Provider’s availability. Any rescheduling request must be made no later than 7 days prior to the original event date, or the Client will be responsible for paying the full amount stated in the Agreement. The Provider will try to accommodate the Client’s requests. However, if the Provider is unavailable on the new event date, the Provider is entitled to retain the non-refundable deposit, and neither party shall have further liability or obligation under this Agreement. Any cancellation request must be made at least 7 days before the agreed event date, in writing. In the event of a cancellation, the deposit paid is non-refundable.

For outside event setups, the Provider may cancel, via any form of communication, at any time due to inclement weather that may cause damage or safety concerns to vehicle or personnel. The Provider will try to accommodate the Client’s rescheduling requests. However, if the Provider is unavailable on the new event date, the Provider will refund any payments within 30 days, and neither party shall have further liability or obligation under this Agreement.

If inclement weather occurs after vehicle setup that may cause damage or safety concerns to the vehicle or personnel, the refund will be prorated based on the hourly rate and any additional equipment used.

Internet Access

The Provider’s photo booth requires Internet access for photo and media files to be sent to guests. If there is no available Internet access, all media files will be sent digitally to the Client within 7 days after the rental has concluded.

Work Environment

The Client acknowledges and agrees to provide a safe and secure work environment free from hazards, attacks, or threats of violence for the Provider’s contractors, employees, and representatives (“Service Providers”) during the event. The Client shall comply with all relevant health and safety regulations and guidelines to ensure the well-being of all parties involved. In the event that the Service Providers feel unsafe, the Provider reserves the right to take possession of all photo booth equipment immediately and suspend the photo booth services for the remainder of the event. The Provider shall not be held liable for any interruptions or impacts on the event caused by the suspension of services due to safety concerns.

Liability and Indemnification

The Provider shall take all reasonable precautions to ensure the proper functioning and safety of the photo booth during the event. However, the Provider shall not be held liable for any direct or indirect damages, lost profits, or increased expenses incurred by the Client or any third party arising from circumstances beyond the Provider’s control, including but not limited to acts of God, natural disasters, power outages, or unforeseen technical failures. The Client agrees to indemnify and hold harmless the Provider and its employees, agents, and representatives from any claims, liabilities, damages, losses, and expenses, including attorney’s fees, provided that such loss or damage was not caused by the negligence of the Provider or the Provider’s employees and contractors.

Force Majeure

In the event that the Client’s rescheduling request is due to circumstances beyond the Client’s control (e.g., acts of God, natural disasters, government restrictions, etc.), the Provider will make every effort to reschedule. Refer to Rescheduling and Cancellation, above.

Confidentiality

The Provider agrees to treat all information provided by the Client as strictly confidential. The Client’s personal information will not be shared without express agreement.

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to this Agreement or the photo booth services provided, both parties agree to first attempt to resolve the matter amicably, seeking a mutually acceptable resolution within 30 days from the date of notification of the dispute. Any unresolved dispute, controversy, or claim shall be settled to the fullest extent permitted by law by binding arbitration. The decision of the arbitrator shall be final and binding on both parties.

Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the invalidity, illegality, or unenforceability of such provision shall not affect the validity or enforceability of the remaining provisions of this Agreement.

Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.

No modification, amendment, or alteration of this Agreement shall be binding unless it is made in writing and duly executed by both parties. By signing below, both parties acknowledge and agree to the terms and conditions stated in this Agreement.
